Introduction

Equilinks is a unique online equestrian marketplace exclusively connecting the local East Anglian equestrian community.

Equilinks is an independent information resource and in such will remain unbiased on all issues.

We expect all Equilinks users to respect the site, the services that we provide and other Equilinks users.

These terms and conditions (together with the documents referred to in them) set out your rights and responsibilities when you use equilinks.co.uk 

Please read these terms and conditions carefully before you start to use the Site. 

By using Equilinks on this, and on each subsequent occasion you confirm that you accept these terms and that you agree to comply with them. If you do not agree to these terms of use, you must not use Equilinks.

Disclaimer

Equilinks is a dedicated marketplace platform for equestrian classifieds and equestrian businesses that acts as a point of contact only.

Any arrangements, payments or contracts between buyer and seller/advertiser are the sole responsibility of the parties concerned. Equilinks is not a party to the contract between the seller and buyer nor is Equilinks liable under it.

Equilinks is not directly involved in any transactions between buyers and sellers. As a result, we have no control over the quality, safety or legality of the items advertised, the truth or accuracy of the listings, the ability of sellers to sell or the ability of buyers to buy.

Equilinks cannot vouch for the quality, authenticity or accuracy of any items, images, information, events, claims or services advertised or displayed on these pages. Please use caution and common sense when using our site. There are risks of dealing with foreign nationals, underage persons or people acting under false pretence.

We do not provide or share personal information, so please ensure that any important information, contracts or records are kept securely.

Equilinks can accept no responsibility for mistakes or omissions on these pages. All submissions are published in good faith as received. 

In the event of a dispute between users, Equilinks cannot act as referee. We are not in a position to judge or take sides, but we may be guided by the ruling or seek advice of official bodies such as Trading Standards.

Equilinks can make no warranty that the contents of the Site are free from infection or viruses or anything else which has contaminating or destructive properties and we shall have no liability in respect thereof. 

Change of Terms

Equilinks reserve the right to alter these terms and conditions at any time and it is your obligation to routinely check if changes have been made before you use the site, the date of the last update will be displayed at the top of this screen.

Your use of the Site after changes are posted on-line shall constitute acceptance of the new terms and conditions.

Terms of Website use

All listings are individually checked before they go live. Equilinks reservers the right to reject (without reason) any listing that does not comply with current UK laws or in breach of theses terms.

All content uploaded must be free from viruses, macro-viruses, trojans, worms, logic bombs or anything else that is malicious or intended to disrupt or interrupt the normal working operations of a computer. You must not attempt to gain unauthorised access our site, the server on which Equilinks is stored or any server, computer or database connected to our website. By breaching this you would be committing a criminal offence under the Computer Misuse Act 1990. You will be permanently denied access to our site and we will not hesitate in reporting any such breach to the relevant law enforcement authorities.

All adverts must comply with the following Listing guidelines:

  • Sellers must be legally able to sell each item that is listed.
  • Listings must hold the correct relevant legal documentation before being advertised.
  • Listings must not contain any material that is sexually explicit, deemed offensive, hateful, inappropriate or obscene.
  • Advertisers must declare whether they are private, trade or from a charity/rescue centre.
  • Listings must be fit for sale and honestly described with any known faults/vices disclosed.

Like any other website Equilinks uses ‘cookies’. These cookies are used to store information including your preferences, and the pages on the website that you accessed or visited. The information is used to optimise your experience by customising our web page content based on your browser type and/or other information. By using this website, we’ll assume that you are happy to receive cookies. If you do not agree, you can disable cookies through your individual browser settings.

Social Media

When submitting a listing to Equilinks, you are giving permission for your advert to be shared across the Equilinks Social Media channels. Equilinks may (at the editors discretion) choose to share your listing to relevant local Facebook groups. This is to maximise any advert, event or business profiles expose to a larger target audience.

Equilinks will only share links on social media that direct users back to the original Equilinks advert.

If you would like to opt out of Social Media sharing, please email the office directly after submitting your advert.

Technical Issues

Access to Equilinks cannot be guaranteed 100% of the time. Due to the technical nature of the internet, you may experience technical issues or down time. 

The site and its services are provided ‘as is’ and ‘as available’.

From time to time we may have to carryout routine or necessary maintenance. We reserve the right to interrupt, withdraw or amend the service without notice. 

Equilinks accepts no responsibility for loss or damages without limitation arising from non-availability.

Account, User names and Passwords

You will need to create an account with Equilinks (completely free of charge) to gain access to some of our Services.

You may create only one Equilinks account per person.

You must be at least 18yrs old to create an Equilinks account.

Equilinks reserves the right to refuse any account applications without reason. We will act in accordance with the law when deciding whether or not to accept your application.

You are responsible for any use of Equilinks under your password and Account login details. We have no responsibility for such use. If you become aware of any unauthorised use of your password or Account please contact us immediately at enquiries@equilinks.co.uk

Account User names must not contain any explicit words, or words that may be deemed rude, inappropriate or offensive. Equilinks reserves the right to refuse or change user names without reason or notice.

Buying an Equine and/or other Animals

Equilinks recommends that perspective buyers should always seek a professionals opinion on the suitability of the animal to the home offered. 

They can also advise on the animals individual welfare needs and requirements according to the current Animal Welfare Act 2006 a pet owner has a legal duty to ensure the welfare of their animal(s).           

A pet’s welfare needs include:

  • A proper diet
  • Somewhere suitable to live
  • Any need to be housed with, or apart from, other animals
  • Allowing animals to express normal behaviour
  • Protection from pain, suffering, injury and disease

The penalty for failing to care for a pet could be a fine of up to £20,000 or even a prison sentence.

Equilinks recommends that you should get any perspective animal vetted by a suitably qualified independent veterinary surgeon. 

It is recommended when looking at perspective equines/other animals that you request to view the animals passport and/or relevant paperwork including any licensing certificates connecting to the breeding of animals before agreeing to purchase.

Equilinks takes no responsibility for any issues arising from purchases made from viewing adverts placed on this site.

Listing conditions

All advertisers must be at least 18yrs old and have the legal capacity to enter into a contract.

Horses and ponies

All equines advertised must be located in the UK.

By UK law all equines must be correctly passported. It is your responsibility to ensure your animals are correctly registered and all details are current and kept up to date. Failure to produce the passport to a trading standards officer may lead to a fine of up to £5000. More information can be found here

As of October 1st 2020, all horses, ponies, and donkeys in England must, by law, be microchipped. More information can be found here

All listings must be clearly advertised as Private, Trade or from a Charity/Rescue Centre. 

All listings must include at least one recent photograph that is a true representation of the equine, it must not be digitally enhanced in any way. 

Equines must be fit for sale and honestly described with any known faults, vices, blemishes and/or health conditions disclosed. It is a criminal offence to falsely advertise or fail to mention any known problems or issues.

Ridden equines must be at least 3yrs old. Any adverts that appear to be showing ridden horses/ponies under this age, will be rejected. 

We do not permit more than one horse per advert unless it is for a broodmare in foal or with a foal at foot (foal must be under the age of 6 months and to be sold with the mare, otherwise a separate listing must be created for the foal) 

Equilinks reserves the right to refuse or remove any listing where there is a reasonable concern for the health and welfare of the equine involved.

Unfortunately we do not currently accept listings for animals that are advertised as (but not limited) to “Free” or “Free to good homes”

Foals & Youngstock
For welfare reasons, please ensure that any foal advertised for sale is at least 4 months old. No pet should be advertised for transfer to a new owner before it is weaned and no longer dependent on its mother.

For Loan and Share 

Equilinks recommends that if you are loaning or taking a horse on loan, for the protection of both parties, please make sure that you have legally binding loan agreement. Further information and Sample BHS loan agreements can be found here

Horseboxes and Trailers

All horseboxes/trailers must be located in the UK

All listings must include at least one recent photograph that is a true representation of the horseboxe/trailer, it must not be digitally enhanced in any way. 

It is recommended that sellers should disclose the vehicles unladed weight so buyers can decide on whether or not the payload is suitable for their individual requirements.

A vehicle’s payload is calculated by subtracting the vehicles unladen weight from its gross vehicle weight (GVW) or maximum authorised mass (MAM). 

Driving a vehicle over its MAM is illegal, potentially dangerous and is likely to affect the way the vehicle handles. More information can be found here and for towing restrictions you can look here

Wanted ads

Wanted adverts are exclusively for private advertisers looking to purchase or loan a horse or pony, horsebox, pet, etc. They must not be used for sellers wanting a buyer or for traders looking for clients.

Pets and Livestock

All animals listed must be located in the UK.

All listings must include at least one recent photograph that is a true representation of the animal that they are selling, it must not be digitally enhanced in any way. 

We do not allow cats to be sold under the age of 9weeks. 

We do not allow dogs or any other mammals to be sold under the age of 8 weeks. Other animals (non mammals) may only be sold once they are capable of feeding themselves and are no longer dependant on their mothers.

We do not accept adverts for animals that are yet to be born. 

We do not accept adverts for animals which are pregnant.

As of October 2020, all cats aged 4 months and over must be microchipped in order to be advertised on Equilinks.

All dogs must be microchipped in order to be advertised on Equilinks as defined by The Microchipping of Dogs Regulations across England, Wales, Scotland and Ireland. It is a legal requirement for all dogs over 8 weeks of age to be microchipped and registered to their breeder. More information can be found here

Advertisers classed as carrying on a business of breeding dogs for sale within the terms of the Breeding and Sale of Dogs (Welfare) Act must be appropriately licenced. Equilinks reserves the right to refuse or remove any listing that fails to provide a current license number. More information can be found here

Members advertising 3 or more litters of kittens or puppies a year will be considered a commercial breeder, and therefore must declare as a Trade seller on their listing.

Equilinks does not accept listings for Pit Bull Terriers, Japanese Tosas, Dogo Argentino, Fila Braziliero, crosses of these breeds, or other dogs of the type controlled under current UK Dangerous Dogs legislation. We also reserve the right to decline listings where we have reason to suspect that a dog is a prohibited type or has the potential to be dangerous, either based on the appearance of the animal or wording of the advert. We do not accept listings for dogs with docked tails born after April 2007, with the exception of working breeds as defined in the Animal Welfare Act 2006 more information can be found here. Any docked working breeds must state that a vet’s certificate is available to verify the docking was done legally. This restriction includes animals born outside England and Wales. Equilinks does not allow the advertisement of dogs that have clipped or cropped ears.

Equilinks does not accept listings for dogs or other animals advertised as suitable for illegal activities such as but not limited to dog/cock fighting and hare coursing.

We do not accept advertisements for animals controlled under the Dangerous Wild Animals Act. More information can be found here

We do not accept advertisements of wild caught animals.

Every purchaser must comply with the duty of care obligations to an animal as specified under the Animal Welfare Act 2006.

In order to meet PAAG minimum standards, Equilinks reserves the right to prevent advertisers placing animal adverts on our site based on their previous account activity. 

We reserve the right to suspend or ban any Equilinks member who we believe is acting in an irresponsible way. We will report any suspicious or illegal activities to the relevant authorities.

Equilinks reserves the right to refuse or remove any listing where there is a reasonable concern for the health and welfare of the animal involved.

Modifications

You are able to edit your listing (s) via your Equilinks account whilst your advert remains paid for and live. Equilinks will receive notifications each time a modification is made.

When a listing is approved, it is for the animal/s or item/s originally submitted only. You can edit the listing via your Equilinks account but we DO NOT allow animals or items to be replaced, exchanged or added after approval. 

If the listing is changed to a different item or animal it will be treated as a new advert. The advert will either be deleted or suspended until payment is received for the new listing.

Listings can and will be deleted without notice if any other changes are made that do not fit within these guidelines.

If we think you are cheating or abusing the system in any way we will reserve the right to suspend or remove any listings until the appropriate advertising fees are paid. Repeat offenders will be blacklisted and refused any future advertising use of the site.

Renewals

Renewals can be made by contacting us at enquiries@equilinks.co.uk

The advert WILL NOT be renewed without payment under any circumstances to bring it back to the top. 

Business sellers

Trade advertisers must declare that they are a business seller.

Under the Consumer Protection from Unfair Trading Regulations it is an offence in the UK if you fail to declare that you are a business seller. You are breaking the law if you mislead potential buyers into thinking that you are a private individual when you are a business seller. More information can be found here

Under UK law, if you sell goods in quantities which exceed the level that it would be reasonable for a private person to sell, it is probable that you would be deemed to be a trader and must therefore comply with trading standards legislation. If you are classed as a trader, advertise online and offer to send items by post, you would also come under the distance selling regulations.

If you are not sure whether you are classed as a trader or not, we advise you to contact your local Trading Standards for advice. 

If Equilinks believe you to be a trader we may contact you for confirmation of your status or change your status to trader without notice.

Equilinks reserve the right to change any advertising pricing. We will always aim to give as much notice as possible.

All listing fees must be paid in full before any advert goes live.

All payments transactions are securely made through Paypal or via BACS. We do not have access to your card details.

By submitting and paying an advertising fee for a listing to be displayed on our website, you acknowledge that you have entered into a contract for an advertising service with Equilinks. When the order is processed, the service is deemed to have started. Any cancellation rights will end at this point as explained in the distant selling regulations for online services.

Refunds and Cancellations

Classifieds

No refunds can be given once a classified listing has gone live.

Cancelling a classified listing can be done before its approval by contacting us in the first instance at enquiries@equilinks.co.uk (there may be a small admin fee to be taken off the final refund)

If a payment is reversed or cancelled after listing has gone live, the advertiser will be in breach of contract & may be refused further use of the classifieds.

Events

No refunds can be given once an event listing has been approved.

Business Directory

Events and Cancelations

Events are subject to change or cancellation at short notice. Equilinks will only update an event listing if requested to do so by the original event organiser. We will do our upmost to update the event listing as soon as possible but this may not be immediately possible. It is recommended that you contact the event organiser directly if you have any questions or concerns regarding their event. 

Equilinks will not be held responsible for any losses relating to the cancellation of events, including but not limited to any entry fees lost, fuel costs and other expenses incurred.

Photographs, Videos and Copyrights

All photographs and/or videos included in the listing must be of the equine, animal or item that its being sold.

Each photograph/video should be a true representation of the animal/item that is offered for sale, it must not be enhanced in any way. 

Videos cannot be uploaded directly to Equilinks, but you can include links to videos posted on the video sharing sites YouTube and Vimeo. As with photographs, you must have permission to use them and they must be non commercial.

All photographs/videos must not contain any illegal, explicit, offensive, inflammatory material or language. Equilinks reserves the right to refuse or remove, without reason any media content that breaches these terms and if necessary, will report any concerning material to the relevant law authorities.

You MUST own or have permission to use any and all images that you use within your listings.

In all cases it is the advertiser’s full responsibility to ensure that they hold copyright or have permission to use a photo/video before it is forwarded on to Equilinks. In most cases the photographer owns the copyright under UK copyright laws. 

In the event of a dispute or if a photograph has obviously been used without permission or a breach of copyright complaint is received, the image will be removed until proof that the photo can legally be used is provided.

Using any photograph without permission or the photographers consent is breaking the law.

Equilinks is not responsible for the actions of its users and will not be held accountable for any issues arising due to copyright protection on photographs. 

Equilinks reserves the right to refuse to publish or remove any photograph/video submitted to the site with out reason.

Removal of Content, Listings and Accounts

At the discretion of Equilinks, we reserve the right to refuse, remove and/or report any content, listing or account without any reason given. We will always act in accordance with UK law. 

Website Links

Where Equilinks contains links to other sites and information resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

Equilinks accepts links to third party websites. No links will be accepted if the site being linked to is a competitor to Equilinks in any way. If the website being linked to offers, accepts, promotes or is associated with another website that supplies online advertisements from third party advertisers the website link will be rejected/removed.

We reserve the right to without notification, refuse/remove any adverts submitted to Equilinks with references to the following in the advert description

    * References to websites

    * Links to websites

    * Details of companies in competition with Equilinks

The web site address stated in the listing must be the website address that the link points to. Redirection of website links to a different website will not be accepted.

Links to commercial websites or business social media pages will be refused or removed. If a removed link is replaced by the advertiser, the entire advert will be subject to removal.

Links to items advertised on other websites or online auctions are not permitted.

Distant selling regulations

By submitting and paying an insertion fee for an advert to be displayed on our site, you are entering into a contract for an advertising service with Equilinks.  

If you wish to cancel your order for a full refund, you must contact Equilinks before the order has been processed. When the order has been processed, the service is deemed to have started. Any cancellation rights will end at this point as explained in the Distant Selling Regulations for online services.

Internet Safety

This is an open public website to maximise exposure. Basic safety precautions should always be taken and you should be aware of online fraud and scams. We will make every effort to offer advice, block and warn of new scammers as soon as possible, but ultimately we cannot control who will see your post or make contact with you. You use Equilinks entirely at your own risk. 

NEVER give anyone contacting you, your personal or bank details, full or part pin numbers, passwords or send/wire them money for any reason whatsoever.

NEVER give your payment details to anyone claiming to be from Equilinks saying there has been a problem with your payment or requesting payment for an advert. We will only call if requested and can provide your advert password as proof of identity.

For safety reasons, anyone under the age of 18yrs must not post an advert on Equilinks.

Intellectual rights property

Any content you upload to our site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but by these terms you grant us and other users of our sites a limited licence to use, store and copy that content and to distribute and make it available to third parties. We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.

Any redistribution or reproduction of part or all of the contents in any form is prohibited other than the following:

  • Sharing is encouraged but it must link to the original content to ensure that only the latest & current content is available.

  • You may copy the content to individual third parties for their private or personal use, but only if you acknowledge the website as the source of the material
  • You may not, except with our express written permission, distribute or commercially exploit the content. Nor may you transmit it or store it in any other website or other form of electronic retrieval system.

The material displayed on Equilinks is provided without any guarantees, conditions or warranties as to its accuracy.

Whether you are a consumer or a business user:

  • We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
  • Different limitations and exclusions of liability will apply to liability arising as a result of the sale of any products to you, which will be set out in the relevant terms and conditions of sale.

If you are a business user:

  • We exclude all implied conditions, warranties, representations or other terms that may apply our Site or any content on it.
  • We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
    • use of, or inability to use our site; or
    • use of or reliance on any content displayed on our website.

In particular, we will not be liable for:

  • loss of profits, sales, business, or revenue;
  • business interruption;
  • loss of anticipated savings;
  • loss of business opportunity, goodwill or reputation; or
  • any indirect or consequential loss or damage.

If you are a consumer user:

Viruss hacking and other offences

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any content on it, or on any website linked to it.

We assume no responsibility for the content of websites linked on our site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

We do not guarantee that our site will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access our website. You should use your own virus protection software.

You must not misuse our website by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our website. You must not attack our Site via a denial-of-service attack or a  distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. 

In the event of such a breach, your right to use the Site will cease immediately.

Breach of Terms

At the discretion of Equilinks, we can and will, without notice, and without refunding any fees, delay or immediately remove Content, warn Equilinks members of a user’s actions, issue a warning to a user, temporarily suspend a user, temporarily or indefinitely suspend a user’s account privileges, terminate a user’s account, prohibit access to the Site, and take technical and legal steps to keep a user off the Site and refuse to provide services to a user if any of the following apply:

  • Equilinks suspects a user has breached this Agreement, the Privacy Policy, or other policy documents and community guidelines incorporated herein.
  • Equilinks is unable to verify or authenticate any of your personal information or content
  • Equilinks believes that a user is acting inconsistently with the letter or spirit of Equilinks’s policies and/or this Agreement, has engaged in improper or fraudulent activity in connection with Equilinks or the actions may cause legal liability or financial loss to Equilinks’s users or to Equilinks.
